ENFORCEMENT ACTIONS REGARDING VIOLATION OF SOUTH RIDGE CCR’S
ARTICLE VII, SECTION 7, LANDSCAPING CONTROL
Upon receipt by the Board of a written complaint, including
a description and/or name of noxious weed(s) and/or other landscaping control
issues and names of owners, the Board will:
- Send a
written notice, via U.S. Postal Service (USPS), informing the member of
the complaint and requesting corrective action.
- Upon
receipt of a second complaint, the Board will send a second written notice,
via USPS certified mail, informing the member of the additional complaint
and request again that corrective action be taken. It will also be explained that further
complaints will result in the assessment of a fine and/or other
enforcement action.
- Upon
receipt of a third complaint, the Board will send a third written notice,
via USPS certified mail, and assess
a fine in the amount of $25.00
- Upon
receipt of a fourth complaint, the Board will send a fourth written notice,
via USPS certified mail, and assess
a fine in the amount of $50.00
- Upon
receipt of a fifth complaint, the Board will send a fifth written notice,
via USPS certified mail, and assess
a fine in the amount of $75.00
- Upon
receipt of any additional complaints, the Board will send further notices,
via USPS certified mail, and assess a fine of $75.00 for each additional
violation.
- Summit County Ordinance 484 states “An owner or
person in possession of property who fails to take action to control or
prevent the spread of noxious weeds as specified in the notice is
maintaining a public nuisance.” At
any time after the third complaint, the county may be requested to take
appropriate action provided by this ordinance. Information is available on
